The Legal and International Advocacy Committee of the National Commission for the Return and Siege Breaking Marches condemns the massacre and the war crime committed by the Israeli occupation forces on the evening of 28/10/2018, which led to the execution of three children by Israeli warplanes, namely: Khalid Bassam Saeed (14 yr), Abdul Hamid Mohammed Abu Zaher (13 yr) and Mohammed Ibrahim al-Sattari (13 yr), from the border area of Wadi al-Sakka, east of Deir al-Balah, which reveals the lies and allegations of the Israeli occupation forces, who indicated that they were planting explosives near the fence. It is worth mentioning that the Israeli occupation forces prevented the arrival of ambulances and medical personnel to rescue them or retrieve the bodies of the martyrs, which according to medical sources were full of shrapnel.
This massacre demonstrates the Israeli occupation forces’ denial of international law through the use of excessive and lethal force against children, in particular the principles of international humanitarian law, which require taking into account proportionality, distinction and necessity. This crime is considered a war crime and a serious violation of the rules of international law and international humanitarian law, and contrary to Rome Statute of the International Criminal Court and the Fourth Geneva Convention. It is a clear denial and disregard the human rights and humanitarian law system that protects civilians in general and children in particular.
The legal and International Advocacy Committee affirms its rejection of the occupation State’s allegations, which seeks to legitimize war crimes committed against Palestinian citizens and children in Gaza Strip, and it considers that the Israeli occupation forces’ deliberate killing of demonstrators, constitutes a war crime in accordance with the Fourth Geneva Convention and the Rome Statute establishing the International Criminal Court; and renews its warning to the Israeli occupation and its military forces against the continuation of the policy of targeting civilians and peaceful demonstrators, and holds it the legal responsibility for this.
Therefore, the Legal and International Advocacy Committee demands the UN and its various bodies, the Security Council, the Human Rights Council, the Special Rapporteurs and the High Contracting Parties to the Geneva Convention to carry out their moral and legal responsibilities to protect Palestinian children and civilians and to work hard to stop the targeting of civilians in Gaza Strip and Palestinian territories, and to hold the occupation leaders accountable for the crimes they committed against children and civilians.
